Lawsuit Released Before School Trustee Served With Papers

School board member has not yet received legal papers.

 

The attorney for Clarkstown teacher Cathy Malgieri filed a lawsuit against Clarkstown School Board Member Donna Ehrenberg on Friday in Rockland County Supreme Court and the papers were released Monday but as of mid afternoon Tuesday Ehrenberg had not been served.

Malgieri’s Attorney Stephen Barry of White Plains said the process server had been given the papers on Friday.  Barry said the turnaround time is typically two or three days and he had expected that Ehrenberg would be served with the legal papers on Monday.  But as of 3 p.m. today, Ehrenberg had not been handed the documents.

“I have no comment, I haven’t been served,” said Ehrenberg. “When I get it I will read it and I will take action on it.”

After speaking with the process server, Barry said the papers would be served either tonight or Wednesday evening.  After the papers are served on Ehrenberg, she has 20 days to file an answer.

alleges Ehrenberg interfered with her contract, violated civil service law, violated her right of free speech and intentionally inflicted emotional distress.
