In the comments that followed a recent article in New City Patch several serious questions were raised by Clarkstown taxpayers concerning the Town's decision to eliminate the position of Deputy Town Attorney, Marsha Coopersmith, and outsource her work to the White Plains law firm of Joseph J. Savino for the Town’s tax certiorari matters.

Clarkstown Retains Law Firm to Handle Tax Certiorari

Surprisingly there has been no response from the Town to any of the questions that were raised. So on behalf of my fellow citizens I call upon the Town Supervisor, Mr Gromack, to provide his responses to the following:

1) Councilwoman Hausner voted against the outsourcing proposal. Why?

2) The Town employs six Deputy Town Attorneys with salaries in 2011 totaling $537,383.  They are: Keith Cornell - $73,841, Richard Glickel - $102,428, Jessica A. Hauser - $75,777, Daniel N. Kraushaar - $98,248, Jeffrey T. Millman - $88,841, and Paul K. Schofield - $98,248.  Why is one or more of these attorneys not qualified to handle the work now being outsourced to Joseph Savino for a 'retainer' of $87,000?

3) Mr Savino resides at : 1959 Colden Avenue, Bronx, NY 10462.   Why is the Town outsourcing work and Clarkstown's tax dollars to an individual who, according to his voter  registration file, does not claim residence in Clarkstown or indeed in Rockland County?

4) Was a bidding process used to hire Savino's law firm?   How many Rockland County law firms were invited to bid?

5) I do not know Ms  Coopersmith personally but if her job was eliminated solely as a "cost savings" it can be assumed that her work for the Town was competent and satisfactory.  This raises the question as to whether she was offered the option to supply the same services to the Town as an external contract employee working on a 'retainer' for the same fee as Mr Savino?

6) Further, now that the Town has set a precedent in outsourcing legal/tax work for the purpose of cost savings, is the Town examining its options to outsource the work of the remaining six Deputy Town Attorneys who are costing the Town over half a million dollars for their in-house services?

Sam Donaldson once remarked that questions never do damage but the absence of satisfactory answers do.   

The questions are asked.  The anwers are awaited.

The job was a payback for the independence line. Frank Spraco and Alex are best buddiies now. Jay is a wanabe Tony Soprano who live in Congers, but has a fake address in the Bronk. He is a Vinny Reda stoodge.

The Rockland GOP is full of such upstanding leadership. Back room deals are the norm.

HBO should start filming a new show about Rockland politics and the one party/family that rules, at the expense of the taxpayers.

This is a slap in the face to taxpayers that this job was outsourced to a blatent patronage job. Marsha Coopersmith was no longer needed as she does not control the Independence party.

You get what you vote for, and Clarkstown got more of the same.

Sparaco's mother-in-law, Debra Ortutay, deposed Coopersmith as chair of the Independence Party. Ortutay filed a complaint about Coopersmith alleging she had committed fraud, accepting checks from politicans.

In a lawsuit (SU-2011-2758 State of New York) Gromack is named as defendant. It states that “one Town Attorney receiving payment of $123,000 was the Chairperson of the Independence Party who provided Gromack that Party Line."  
Ortutay stands indicted for perjury and fraud.  She hired Bronx Republican Chairman Jay Savino as her attorney!

Why does the town need 6 deputy town attorneys and what do they all do? Some have privater proctices in addition to the town "work" they are being paid for so why is so much moeny being sopent in this area and who supervises these lawyers?

Please request that the meeting be with Gromack only no lawyers like Amy Mele.This is not a legal matter He is either supervisor and can handle the questions or he isn't. If he needs legal representation to even talk he is un qualified to be supervisor.I don't care what the self imposed Clarkstown policy is.If these were his decisions he should be capable of answering how he arrived at them without a mouthpiece.

The GOP candidate trying to unseat Democratic state Sen. Jeff Klein in The Bronx couldn't pass a background check when he was nominated for a government post in 2004.

Sources said investigators wouldn't certify Jay Savino as a resident when his name came before the City Council for confirmation as a Board of Elections commissioner. "They couldn't determine where he really lived," one source said.

The full council never acted on the appointment. But he got the job when the council's three Republicans gave him their approval, as allowed by law.

Savino told The Post he had always lived in The Bronx but "my wife was going through a difficult pregnancy, and with our two young boys a handful, we decided it would be best for her to move in with her mother, who owns a house in Rockland County."

The unusual arrangement lasted about 18 months.

Town Board member Stephanie Hausner was the lone vote against hiring Savino. She said she voted “no” because she would have preferred to have an attorney from Clarkstown or Rockland.
“I think there are other individuals who are qualified or more qualified to do this job. They may not come with so much baggage,” said Hausner. “I wasn’t comfortable voting yes on this appointment. I didn’t feel like abstaining either.”

He got the independence line as well, so he can't speak up. BTW, does Frank ever go against Alex on votes, besides the term limits vote? He just voted for the CSEA raises stating that he wished we (the town) got more. What a joke.

There really should be an investigation on this whole Savino matter and not with local law enforcement, maybe the state attorney general. Was there a bid process? No. How come the remaining assistant district attorneys could not each assume a piece of the duties of the outgoing ADA. Remember do more with less. And plus what bothers me about Savino is that he does not live in the Bronx but he has voter registration there so that is how he can attain his Bronx County GOP leader status. Savino lives in Congers, NY. How can we have this lawyer who has a possible voter registration fraud and with alot of questionable baggage plus having no experience in municipality matters. I would really like to see proof of the bidding process, if there was ever one done. I can say that I honestly believe that Jay Savino is using his Bronx County GOP leadership status as a means of getting political patronage perks for his personal gain. I think the residents of Clarkstown deserve alot better. I think that there are many other Clarkstown and Rockland county lawyers that are more qualified and legitimate to handle the public's governmental duties.

Until Monday afternoon, the website of Savino’s law firm, Faga Savino, listed its practice areas as civil litigation, personal injury, matrimonial law, criminal defense and real estate, among others. Later in the day, following a reporter’s inquiry, it added the category of tax certioraris.

Savino’s firm was chosen because its bid was the most competitive, and Mele said, “We found them to be eminently qualified for the job.”

Question: How can you be qualified for a job, when you do not have the experience for the job?

In the LoHud article it states that The resolution for the vote says Town Attorney Amy Mele “researched and interviewed law firms with experience in such matters and has requested rates and proposals from said firms.”

I really would like to see any evidence or documentation that shows proof that other law firms were researched and interviewed. This should be made accessible to the public. I will be doing a FOIL on this.

Jay Savino does not live in the Bronx, will Mr. Savino have enough time this year to tend to Clarkstown governmental duties. He has a very busy year for him with elections. Plus running his own law firm? I have never heard of a Bronx County GOP Leader living in Rockland County. And I will be posting more in the coming days. Clarkstown government has just have to be plain nuts and insane for hiring Jay Savino. All these so called Bronx GOP dinners and meeting in Rockland County is all front. I really believe that Mr. Savino used campaign finance funds to expand his network of getting more personal gain through political patronage. These were not dinners or meeting with Bronx GOP committee, these were dinners and meetings with political party bigwigs in Rockland County to further enhance Mr. Savino own personal gain. What a shame we have such people giving politics a bad name. This is why people do not vote or participate in elections anymore. If we have any chance of making a better government in this country, let it start in Clarkstown, let’s clean up this town and get rid of all these corrupt elected officials, and corrupt political party leaders, members and lawyers. There are two ways to get rid of them, through elections and also bringing the corrupt to a court of justice. God Bless America
