A Rockland County father has been sentenced to 5 to 15 years in state prison for the 2011 beating death of this 5-month-old daughter.
Michael Aviles, 42, of 153 Hudon Ave., Haverstraw, was convicted of second-degree manslaughter and criminally negligent homicide in January after a trial in Rockland County Court in New City. He was found guilty of causing the death of his daughter, Michelle.
said that in the early morning hours of Jan. 16, 2011, the infant suffered multiple fractures to her skull and ribs, and internal bleeding following what was described as a savage beating by Aviles in the apartment he shared with Lissette Capellan, 23.
Zugibe said the unresponsive infant, wrapped in a towel and wearing a diaper, was later driven to Nyack Hospital by the Aviles. After being transferred to Westchester Medical Center in Valhalla, the infant was pronounced dead at about 11:45 a.m. that same day.
In addition to the 5 to 15 years in state prison, Aviles was ordered to serve 1 1/3 to 4 years on the criminally negligent homicide count. Executive Assistant District Attorney Stephen Moore and Senior Assistant District Attorney Patricia Gunning prosecuted the case.
