UPDATED: Police Report DWI Arrest With Child In Vehicle

Sloatsburg resident arrested early Friday morning and charged under Leandra's Law for driving while intoxicated with a child in the car, driving while intoxicated, refusal to take breathalyzer test and speeding.

 

Clarkstown Police reported Stephaine Rivera of Sloatsburg was arrested at 3:30 a.m. Friday under Leandra's Law for driving while intoxicated with a child younger than 10 years old in the car.

Rivera was arraigned in Clarkstown Justice Court on charges of aggravated driving while intoxicated with a child passenger less than 16 years old, a felony; driving while intoxicated, a misdemeanor; and refusal to take breath test and speeding, both violations.

According to police, Rivera, 24 years old, was driving a 1997 Chevrolet at a high rate of speed when she was  stopped in Clarkstown on the northbound New York State Thruway. Police said Rivera appeared to be intoxicated and was given field sobriety tests which she failed.  They took her and the passenger to police headquarters.  

Police report Rivera refused to take a breathalyzer test. She was arraigned in Clarkstown Justice Court and remanded to the Rockland County Correctional Facility in lieu of $2,500 bail and is due in court on 9/24/12.

The child passenger was uninjured and was released to a family member.
